A Section 10.7 Planning Certificate provides essential information about zoning, planning controls and constraints that affect how a property can be used or developed.

Types of Planning Certificates

Basic s10.7 Planning Certificate - Part 2

The Basic s10.7 Planning Certificate - Part 2 provides information under section 10.7(2) of the Environmental Planning & Assessment Act 1979 and is outlined in Environmental Planning & Assessment Regulation 2021 Schedule 2.

The certificate includes zoning, development standards and matters affecting the land of which Council is aware, including (but not limited to):

Name of the relevant planning instrument and DCPs
Zoning and land use planning controls
Exempt and complying uses
Whether development control plans, site-associated planning policies, and planning proposals apply
Whether land is affected by the following:
A heritage item
Located in a conservation area
Subject to a tree preservation order
Identified as bush fire prone land
Affected by coastal protection
In a mine subsidence district
Subject to flood-related development controls
Susceptible to acid sulfate soils
Identified in the Loose Fill Asbestos Register

It also outlines matters prescribed by Section 59 of the Contaminated Land Management Act 1997 if the land (or part) is affected by contamination and this is reported to Council.

Note: The Basic Certificate does not contain the additional advice provided under section 10.7(5).

Comprehensive s10.7 Planning Certificate - Part 2 & 5

This includes everything in the Basic Certificate plus additional advice on matters affecting the land that are not listed in the Environmental Planning & Assessment Regulation 2021 Schedule 2.

It is recommended you apply for the Comprehensive Certificate as it may contain information not included in the basic certificate, such as:

Natural hazard listings
Australian Heritage Database listings
Declared Aboriginal Place
Strategic reports
Environmental studies
Soil contamination
Acid sulfate soil mapping
Land use agreements or planning studies
Key constraints (e.g. flood, stormwater)

Urgent applications

One application per lot

If your property spans multiple lots under one street address:

All lots will be automatically included in your application.
Fees will be charged for each lot included.

Finding a property by Lot and Deposited Plan or Strata Plan:

When you start your application, you will be asked to identify a parcel of land either by property address or land.
Select land to enter a lot and DP or lot and SP.
Use the format lot/DP, for example 1/123456.

For strata title land, if the certificate is for the entire site, only one application is needed.

Planning and zoning information online

You may also use the NSW Planning Portal Spatial Viewer to view zoning maps.
Maps under the Newcastle Local Environmental Plan 2012 including zoning, floor space ratios, building heights, heritage, and acid sulfate soils are available for download in PDF format from the NSW Planning Portal.
The LEP 2012 includes both the planning instrument and associated maps. Once you identify the zoning for a property, refer to the Land Use Table in the instrument for more details about what is permitted in that zone.

It's important to note that information from the Planning Portal does not replace a Planning Certificate.

Outstanding Orders and Notices - lists any current or unresolved notices and orders issued by City of Newcastle
Rating Certificate (Section 603) - identifies outstanding rates or debts against a property.
Pollution Form - if you would like to discuss the contaminated land attribute noted on a planning certificate.

Next steps

Shortly after submitting your application, you will receive an email confirming we've received it, along with a receipt for your application fees. Your application will be reviewed and processed. If we require any additional information or clarification, we will contact you.
Upon completion of processing, you will be emailed your Planning Certificate.

Time frames

Planning certificates are typically emailed within 5 business days.
Urgent planning certificates are emailed within 1 business day.
